Lee v. ITT Class Action

As many of you know, our firm was appointed Class Counsel to represent a class of employees who formerly worked for ITT (now "Vectrus Systems Corporation") in Kuwait. Recently, the Class Representatives and our firm reached a tentative settlement with Vectrus. We are working toward a Final Settlement Agreement to be completed by April 13, 2018, which will be submitted to the Court for approval.

Earlier, the U.S. District Court in Seattle certified a class of "All employees of Defendant ITT Corporation or its subsidiaries who performed work under the 'GMASS' contract in Kuwait on or after April 12, 2009." According to Vectrus, the GMASS contract ended May 29, 2010.

The tentative settlement calls for total settlement funds to be capped at $3,750,000.00, not including Vectrus' contribution to employer payroll taxes. This amount will cover payments to eligible class members, attorneys' fees, litigation expenses and other related and Court-approved amounts.

A Final Settlement Agreement will require preliminary approval by the U.S. District Court in Seattle. If approved, a Notice will issue to class members notifying them of the details of the Agreement.

Subsequently, the District Court will conduct a fairness hearing to grant final approval. After final approval, class members will receive a W-4 to complete and return (or a different form for non-U.S. citizens). Class members must return these forms to be eligible. Then, eligible class members will receive checks from Vectrus based on each individual's number of days worked in Kuwait under the GMASS contract.

We anticipate that the entire settlement process will require many months to complete.
